A mercantile license must be purchased from the Borough of Berlin, especially for those who rent on a consistent basis.

Each vendor must leave their rented space (s) in the same condition that it was in the morning. All small trash is to be put in the cans provided and ANY UNSOLD MERCHANDISE MUST BE TAKEN WITH YOU WHEN YOU LEAVE. No nails, screws or staples are permitted to be put in the table provided for your use.

The sale of explosives, firearms, ammunition, flammables, alcoholic beverages, dangerous items, or items of any obscene or pornographic nature is not permitted. DRUGS OR DRUG PARAPHERNALIA, ILLEGAL, COUNTERFEIT, OR STOLEN ITEMS ARE PROHIBITED FROM SALE. The management reserves the right to inspect ALL items proposed to be sold and the right to eliminate any items from sale that, in the opinion of management, is unacceptable. Also, the manner in which anything is displayed is also subject to revision or elimination at the discretion of management.

No prepared foods, including snack items or beverages may be sold. No flyers, handbills, or leaflets may be distributed without prior written approval of management.

No one is permitted to drive ANY vehicle in the flea market area between 9 am and 4 pm without assistance from security personnel.

All spaces rented weekly must be occupied by 8 am and all monthly spaces by 9 am or they will be re-rented.

Management reserves the right to refuse entrance or evict anyone from the premises without notice.

No animals, pets of any kind are to be sold, traded, or allowed on the property.

Seller must collect sales tax where applicable.

Seller shall, upon request, furnish full name and show valid identification (s).

 RAINED OUT*** No rain until 11 am constitutes a full market day. Bring any appropriate cover as drizzle does not constitute rain.

NO SHOWS FORFEIT DEPOSIT.

management is not responsible for supplying any tables, services, electricity or display materials.

No merchandise or vehicles are permitted on the property after 6 pm Sunday or before 5 pm Friday.

No tires or mattresses are allowed to be sold.

No vendor will use his or her rented space (s) so as to interfere with or jeopardize the health and safety of others. Vendors must regulate the volume of sound equipment, etc., in order to not interfere with adjoining spaces. Any material which is construed as offensive , loud, or abusive will not be tolerated.

Vendors are expected to conduct themselves in a business professional manner.

Vendors agree to make satisfactory exchanges or refunds to a customer, unless an acceptable return policy by management is POSTED in a conspicuous place. All vendors and their employees agree to abide by the following traffic regulation:
1. To drive in a slow and safe manner, not exceeding 5 mph.
2. To come to a full stop at all intersections and stop signs.
3. To heed the signals of flea market employees.
4. To ALWAYS yield the right of way to pedestrians.

Management is not responsible for injuries caused by others or persons entering these premises. Also, management is not responsible for articles which are damaged, lost or loss due to fire, theft, breakage or collision.

Rules and rates are subject to change at management's discretion.

Seller shall conform to any and all state laws that may govern a swap n' shop flea market of this type.

Vendors are not permitted to sublet their rented space (s).

Management reserves the right to remove, refuse, or cancel any admittance or rent contract to anyone who violates ANY of the above rules and regulations stated above, or persistently causes disturbances, with no refund.
